Ksubi Receives Cease and Desist From In-N-Out Burger

If you’ve strolled down the Paddington end of Oxford Street recently, you may have noticed a new-ish storefront claiming to be the first Australian outpost of Californian fast food chain In-N-Out Burger. Sadly, for lovers of luscious grilled meats and heart attacks (seriously, look at this monstrosity) the placard, which read “In-N-Out Burger Opening Soon…”, was actually a decoy sign for the new Ksubi flagship store which will soon replace their previous Glenmore Road address.

Puzzled and understandably peeved with the Sydney label’s unauthorized use of their logo, executives at In-N-Out allegedly threatened legal action against Ksubi late last week. And now, according to an email we received from Ksubi earlier today, the label has since received a Cease and Desist and taken down the offending signage.

Says Ksubi: Ksubi are big fans of In-N-Out Burger, and this, if you like, was testing the public’s appetite towards a Sydney branch, and it was overwhelmingly in favour. We received a Cease and Desist, and have removed the poster. The new ksubi store is located at 140 Oxford Street Paddington and will be open next week.

No stranger to litigious Americans, Ksubi were forced to change their original name (Tsubi) in ’06 after US shoe brand Tsubo claimed trademark infringement.
