Judge Throws Out Kesha’s Case, Says ‘Not All Rape Is A Gender Hate Crime’

USA Today reports that Supreme Court Justice Shirley Werner Kornreich has thrown out most of Kesha‘s case against Sony, and producer Dr. Luke

Kesha tried to sever ties with her management on the grounds that Dr. Luke (real name Lukasz Gottwald) raped her twice during her contract. 
Kornreich has thrown out the case, saying that Kesha’s claim that the producer allegedly raped her in an aeroplane in 2005 and in a hotel in 2008 were outside of a 5-year time limit, and also happened outside of New York.
In response to Kesha’s claim that working with Sony meant that she was forced to work with her abuser “like a slave”, Kornreich said: 

“Slavery has been outlawed since the 19th century.”
Kesha also argued that the alleged rape could be counted as a gender-related hate crime. Kornreich also tore this down, saying, 
“Although [Dr. Luke’s] alleged actions were directed to Kesha, who is female, [her claims] do no allege that [Luke] harboured animus toward women or was motivated by gender animus when he allegedly behaved violently toward Kesha.

Every rape is not a gender-motivated hate crime.”

Kesha posted on Instagram earlier this week that Sony told her they’d happily break her contract terms, so long as she took back her accusations that Dr. Luke raped her. She obviously declined:
