1.  Information on all elements of the MIDORI Summer Beach Party (‘Promotion’) from site usage, login, RSVP and entry to events will form part of these Terms and Conditions. Entry into the Promotion will signify acceptance of all terms and conditions.
 
2.  Promotion commences at 3pm 2nd November 2012 and ends at 5pm (Sydney time) on 6th December 2012 (Sydney time) (“Promotional Period”).
 
3.  The participant agrees to provide correct, current and complete information relating to their participation in the promotion.
 
4.  Entry and nominations are only open to Australian residents over the age of 18. Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion, are ineligible to enter.
 
5.  Pedestrian Group Pty Ltd (ABN: 60112839568) (‘Promoter’) takes all care but no responsibility to ensure that all entries are received and processed. The promoter will be in no way responsible for any entry not being processed due to technical fault, omission or any oversight.
 
6.  All entry processing, event region shortlisting, RSVP vote quantification and judging co-ordination will take place at the office of the Promoter, Suite 306, 4-14 Buckingham Street Surry Hills, NSW 2010.
 
7.  The region with the highest amount of RSVPs will result in the event being held in this region (an RSVP is defined as a person joining the designated Facebook event for the region) Registering an RSVP in the voting phase of the promotion does not guarantee participants entry to the MIDORI Summer Beach Party. Participants that register an RSVP to the winning region will be selected to attend based on a 25 words or less challenge to win double passes to attend the event following the announcement of the winning region via Pedestrian.tv. The number of participants selected to attend the event will be based on the capacity of the selected venue.
 
8.    MIDORI (brand of Suntory Australia) is the official sponsor of the Promotion (‘Sponsor’).
 
9. By registering an RSVP, the participant confirms
 
a) That he / she is over the age of 18 years old.
b) That he/she understands they have the chance to win tickets to the event by a game of skill in the circumstance that their region receives the most RSVPs, and at no point are they entitled to receive an invitation to the event.
 
10.   The promoter is in no way responsible for ensuring that any particular individual that RSVPs for the event adheres to the criteria outlined in clause 9 above.
 
11. The ultimate venue selection for the event within the winning region is at the sole discretion of the Promoter. The proximity of the venue to the winning region will be based on venue availability and suitability in meeting the production requirements of the event.
 
12.  Participants who login to the site via Facebook and successfully provide their first name, surname, email address and age will receive a $20 voucher code to online retailer The Iconic (www.theiconic.com.au). The voucher must be part of a minimum spend of $69, is not valid for use on sale items, expires on 31/01/2013 and is for one time use only. The voucher code will be emailed directly to the participant’s email address (that is connected to their Facebook account) within 24hrs of providing their information. Usage of the voucher code is governed by the terms and conditions available on The Iconic website. The voucher may not be redeemed or substituted for cash.
 
13. Entrants can register RSVPs to the Promotion from 3pm (Sydney time) 2nd November 2012 until 5pm (Sydney time) on 6th December 2012 (Sydney time). The promoter takes no responsibility for any technical issues, faults or errors associated with the promotion site and will have final authority over the selection of the winning region, location and event attendees.
14. Participants can register an RSVP to multiple locations if they so wish, however only one region will be titled the location of the MIDORI Summer Beach Party. All entrants to the winning region will have the opportunity to win a double pass to the event via the 25 words or less challenge hosted on the Facebook event of the winning region. This will be uploaded to the page at midday on the 12th of December 2012. The winners of the double passes will be notified through Facebook by the 19th of December 2012. Only successful respondents will be contacted.
 
15.  The MIDORI Summer Beach Party Event event will be held on the evening of Thursday January 24th 2013. Prize value of double pass to the event does not exceed $100. The prize is for tickets only and doesn’t involve any transport, transfers, flights or other associated costs for the successful user to attend the event. The prize is non-transferrable and may not be redeemed for cash.
 
16.  This competition is a game of skill and chance plays no part in the competition.
 
17.  The information provided by an entrant to the promotion may be used by the Promoter.
 
a) As part of sales campaigns, contests, invitations and loyalty programs
b) to communicate with users and winners
c) by the Promoter, Sponsors and their agencies, clients or related 3rd parties for the actions and goals outlined within points (a) and (b) above.
 
18.  The Promoter reserves the right, at any time, to verify the validity of entries and to disqualify any user or region that has engaged in activity that is not in accordance with these Terms and Conditions or who tampers with the entry/voting process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
 
19.  If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any user or region; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
 
20.    If, for any reason, the Promotion is not capable of running as planned due to any reason including, but not limited to, infection by computer virus, bugs tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the RSVP process, and to cancel, terminate, modify or suspend the Promotion.
 
20.    If, for any reason, the Promotion is not capable of running as planned due to any reason including, but not limited to, infection by computer virus, bugs tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the RSVP process, and to cancel, terminate, modify or suspend the Promotion.
 
21.     The Promoter reserves the right to disqualify any entrant who in the opinion of the Promoter, engaged in conduct in entering the Promotion which is fraudulent, infringes third party intellectual property rights, is misleading, deceptive or generally damaging to the goodwill or reputation of the Promoter or Sponsors. The Promoter reserves the right to disqualify a user or regon if the Promoter becomes aware that the user or region’s entry is of a type described in this clause.
 
22.     Each entrant agrees that their name, statements, video, voice, photograph, or other likeness may be used with whatever visuals, copy, or other elements the Promoter, Sponsor or associated agencies may determine, in its sole discretion, for all media usage in perpetuity without remuneration (including, but not limited to, usage on the Internet), but only in connection with this Promotion (which, without limitation, includes the Promoter’s and/or Suntory Australia’s websites and facebook pages used in connection with the Promotion). Nothing herein shall obligate The Promoter, Sponsor or their associated agencies to use the entrant’s name, address, e-mail address, statements, video, voice, photograph, or other likeness.
 
23.     Except for any liability that cannot be excluded by law, the Promoter and Sponsor (including their officers, employees and agents) exclude all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Promotion including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s or the Sponsor’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of the prize.
 
24.     The Promoter reserves the right to change or amend any of the Terms and Conditions outlined above with adequate and fair notification to all participants involved in the promotion and in no way is held responsible for any consequential actions stemming from these changes.
 
25.     If any part of these terms and conditions is deemed void or unenforceable it will only be ineffective to the extend of such voidness or unenforceability and will not invalidate the remaining provisions.
