Lindsay Lohan’s Lawsuit Against The Makers Of GTA V Has Been Tossed Out

There’s always going to be a little part of us that has faith in Lindsay Lohan‘s ability to make a meaningful comeback, but the actress suffered a blow this week, with her lawsuit against the makers of GTA V officially being tossed out of court. 
Two years ago, Lohan took action against  Rockstar Games and Take-Two Interactive, saying that an image of a bikini-clad woman flashing a peace sign, featured as part of the game’s artwork, was based on a photo of her. 
She claimed that flashing a peace sign was her “signature” gesture, and also a character who appears in the early parts of the game – a vacuous actress named Lacey Jonas, who is stalked by paparazzi – is based on her.
Lohan said that the illustration, combined with the in-game character, constituted “unequivocal” references to her without her permission, and in her complaint, said that her right to privacy had been violated by the game.
In a ruling that will probably be very reassuring to anyone who enjoys taking the piss out of celebrities without getting sued, a five-judge panel in a Manhattan appeals court dismissed Lohan’s complaint without costs. 
Both Lohan and reality TV personality Karen Gravano had attempted to sue. In their ruling, the judges noted that books, video games and other works of satire or parody are protected by the First Amendments, saying:
“Even if we accept plaintiffs’ contentions that the video game depictions are close enough to be considered representations of the respective plaintiffs, plaintiffs’ claims should be dismissed because this video game does not fall under the statutory definitions of “advertising” or “trade” … This video game’s unique story, characters, dialogue, and environment, combined with the player’s ability to choose how to proceed in the game, render it a work of fiction and satire.”
Looks like Linds will have to rely on those lucrative Instagram endorsements to keep the money rolling in for now. After all, a girl’s gotta eat:
