The couple, who were together for ten years, were recently told off by a judge of the Los Angeles Superior Court, who warned that their matter might be dismissed because they were taking too long, which would have forced them to start over.

According to reports from gossip monsters TMZ, the couple did not have a prenuptial agreement, but have now reached a property settlement, and have agreed to joint custody of their three children Violet, Seraphina and Samuel.

Last weekend, Ben Affleck was seen on a date with Playboy model Shauna Sexton, leading to speculation that he had split from his girlfriend, Saturday Night Live producer Lindsay Shookus, with whom he went public last year.

This speculation was later confirmed, with reports that Shookus had encouraged Affleck’s sobriety and ongoing recovery, and had attended meetings with him, but was concerned that he had begun to “spiral” in recent months. A source close to the couple said:

“It was very hard for her to break up with Ben, but she knew he wasn’t getting better and that it was time for her to step aside. She was trying to stay as close to him as possible so that he would stay on the right path, but ultimately it just wasn’t possible. She knew she had to let him hit bottom … All she wanted was for him to be happy and healthy. It was a difficult choice but the right one.”

Garner was seen driving Affleck to rehab facility The Canyon at Peace Park in Malibu, and the pair stopped for fast food along the way.
